Changes to the state sanitary rules for planning and development of settlements

A notice has appeared on the website of the Ministry of Health of Ukraine about the publication of a draft order of the Ministry of Health of Ukraine “On Approval of Amendments to the State Sanitary Rules for Planning and Development of Settlements”. This concerns amendments to the State Sanitary Rules for Planning and Development of Settlements, approved by the Ministry of Health No. 173 dated June 19, 1996.

The purpose of these changes is to correct the legislative problem with the issue of reducing the regulatory size of sanitary protection zones (SPZ). This problem appeared almost two years ago with the entry into force of the new law “On the Public Health System” and the automatic repeal of the law “On Sanitary and Epidemiological Well-being”, since the new legislation has eliminated the concept of sanitary and hygienic expertise, according to which conclusions on reducing the size of SPZs were approved.

Thus, for almost two years, due to the lack of a procedure, no business entity could legally justify the actual SPZ, which historically was formed for reasons independent of the enterprise, as a rule, not in its favor. It should be noted that such a problem may not manifest itself, but became an unpleasant surprise when trying, for example, to obtain an emissions permit.

Also, this issue was of critical importance when conducting an environmental impact assessment (EIA), strategic environmental assessment, environmental impact assessment (EIA – section of a construction project), when developing urban planning documentation, etc.

Therefore, many who sighed with relief when they saw that, finally, this issue has acquired state importance and it is time to draw the attention of the Ministry of Health to it. However, the essence of the changes requires, at a minimum, clarification of how exactly the lawmakers propose to resolve this in the future.
